Dear Mr. Shadis:

This letter responds to your request, dated August 8,1979, for a sixty-day extension of time within which to file coments on the NRC Advance Notice of Proposed Rulemaking on emergency planning.

The Comission, in response to concerns raised by the Congress and by the public and in the exercise of its duty to protect the public health and safety, has detenn-ined that this particular rulemaking ought to be completed on an expedited. basis by the beginnin'g of 1980.

Accordingly, a sixty-day extension of time would c=cpro-mise these considerations and, therefore, your formal request is denied.

You should note, hcwever, that the particular advance notice you nefer to is not a proposed rule but a request for coment.

The proposed rule, when published in the next two months, will provice for another opportunity for public comment.

In addition, because the rulemaking proceeding is still ongoing, your coments, when received, can be given consideration and will not be ignored simply because you cannot meet the August 31 deadline for the first round of coment.

Finally, the Commission ruTemaking proceeding will not involve fonnal proceedings (which would involve interventie.n) but is considered "infonnal" rulemaking, involving the solic-itation, analysis, and consideration of public written cement, T: that ertent, your participa-tien is not th3t of a party in a Comission adjudication but rather, is like that of any other person or organization that chooses to cournent on the proposal.
