We have received a copy of your application for license amendment notarized May 4,1979, and transmitted by letter dated itay 8,1979, from LeBoeuf, Lamb, Leiby & MacRae. The application was filed with the Office of Nuclear Reactor Regulation (ONRR) for review and approval of deletion of the water quality limitations from the Fort Calhoun Appendix B Technical Specifications of License No. DPR-40. Your application included a Class II license amendment fee of $1,200 pursuant to 10 CFR 170.22 because you determined that it was pro forma and administrative in nature.
Based on guidance from the ONRR staff as a result of their preliminary review of your application, it has been determined that the above application requires a Class III amsadment fee rather than a Class II fee because it involves con-sideration of an environmental issue that is not considered to be pro forma nor administrative in nature. Therefore, it is requested that an additional
$2,800 be forwarded to this office.
If final review of your applicaticn by the ONRR staff reveals that this fee determination is incorrect, you will be refunded any overpayment or billed for any additional amount due.
