The Ccamissioners Second, the NRC and DCE have research programs in progress to determine the response of spent 1el and spent fuel casks to explosive sabotage.
~;:e results of these programs cculd be instru,T. ental in arriving at S determination concerning future safeguards pelicy for spent fuel shicTents. Early results are expected during the surrer of 1981.
Staff believes it should evaluate the results of these programs before emoarking on a new spent fuel shipment' rcuti ng policy.
'With respect to the secord question raised by the Connission, the staff telieves that the NRC snculd nct attempt to overrule a state that designates a non-inter!; ate alternative unless there is scoe significant safeguards Or safety weakness in the state preferred route.
In tne interest of safeguards, the NRC has expressed a strong preference for the use of interstates for hignway shipment of spent fuel.
At the same tire, some partion of each highway shipment of spent fuel must be made on ncn-interstate hi;hways.
Safeguards regulations have therefore been designed to assure adequate protection of shipments on either interstate or non-interstate hi ghways.
Under preser;t policy, any rcute sagmont to be used, ir.cluding a state designated non-interstate highway, would first be considered on its cwn merit by the safeguards staff.
The DOT rule is intended to assure that only high quality alternative routes could be designated by states and sucn routes are likely to satisfy safeguards criteria.
'n view of tne foregoinc ar.d barring sone sicnificant safeguards weakness, the staff would not use safeguards as a basis for overruling a state that designates non-interstate alternative rou te s.
With respect to the safety aspects, the CCT, rather than the NRC, regulates routing of shipments in the interest of safety.
The NRC has provided technical advice to 00T cn routing, but NRC Mas no safety related routing recuirenents in its regulations.
Accordingly the ',RC woul d *ot expect to overrule a state preferrec non-interstate route for safety reasons.
