SUBJECT:
DRESDEN 1 DECONTAMINATION HEARING REQUESTS We have just been informed that the recomendation from OGC (SECY 81-223) to the Comissioners on disposition of the requests for hearing on the Dresden Unit 1 decontamination have been returned to OGC. We also under-stand that the OGC lead attorney will not be in a position to promptly modify their proposal because of higher priority casework. No date is available for when a revised recommendation would be forwarded.
As you are aware, OELD will not concur in the issuance of the authori-zation until the Commission ruits on the petition.
I reconmend that we ask them to review the package (SER, amendment and letter) and pro-vide their comments. The NRR staff would then make whatever modifications are necessary and then hold the authorization.
I suggest that we issue our safety evaluation and continue to withhold amendment. That way we will be ready to go to hearing (FES is already out) or promptly issue the authorization depending on how OGC and the Commissioners rule.
