Dear Mr. Dignan:
I am in receipt of your December 4,1980 " Request for a Hearing" regarding the
" Order for Modification of License" issued to Boston Edison Company effective October 24,1980 (Order), which expressed your opinion that the Order could not be made imediately effective. Contrary to your view, it is our position that the decision of the United States Court of Appeals for the District of Columbia C:rcuit in Sholly v. NRC, F2d.
. N9s. 80-1691, 80-1783, 80-1784 (November 19, 1980) has no effect upon the Ccmission's authority to issue orders which are imediately effective when the public health, safety or interest so requires. In particular, it is our view that the Sholly decision had no impact whatever on the imediate effectiveness of the Octobe-24, 1930 Order regarding environmental qualification of electrical equipment. Therefore, we expect strict compliance on the part of Boston Edison Company with the provisions of that Order.
