This is in response to your letter of August 30, 1979, regarding route approvals for shipments of spent fuel from Oconee Nuclear Station to McGuire Nuclear Station.

Your request for a reversal of our decision to disapprove that portion of the primary route that passes through Charlotte, NC is denied.

The requirement for avoiding heavily populated areas, as contained in 10 CFR73.37(a)(3), can be abrogated cnly if it can be shown that no

.racticable alternate routes are available. As indicated on page 3 of your letter, you do not consider the alternate routes (defined in previous correspondence) to be unacceptable.

Please be assured, however, that your general views on route selection criteria will be taken into account during the staff's review of public comments submitted in response to the publication of this new rule.
