In August 1979, Nuclear Metals, Inc. applied for a license to export 100,000 kilograms of depleted uranium as derbies or billets to NUKEM, West Germany to be used as melt stock for the manufacture of depleted uranium counter # eights and shielding for radiotherapy units.

In determining whether the quantity of material is reasonable for the proposed end uses, the staff has been informed that shielding for one radiotherapy unit requires up to 1000 kilograms of material, and that an aircraft the size of a Boeing-747 typically requires up to 500 kilograms of depleted uranium for counterweight purposes.

Since counteraeights and radiotherapy units are in widespread commercial use, the amount requested appears reascnable. The staff believes that assurances against nuclear end uses are not necessary, as NUKEM and the Government of West Germany are not involved in nuclear-related military activities.

It is noted that before NRC issued a license to COGEMA for similar material (see SECY-79-368), the staff requested confimation from the consignee that the material would be used only for non-nuclear end uses.

That assurance was requested because COGEMA and the Government of France, of course, are involved in nuclear related military activi ti es.

Facility attachments are in effect for the NUKEM facility.

Depleted uranium for a non-nuclear end use is not subject to the export licensing criteria in Section 127 of the Act 7910240357 mm r

Further, such materials fall within the (cont'd) categories of materials listed in 10 CFR 110.41(d) which are not normally reviewed by the Executive Branch.

The staff has concluded that there are no material changed circumstances concerning exports to West Germany which would affect the Commission's consideraticn of this case and which have occurred since export license XUO8394 covering source material for a non-nuclear end use was issued on January 20, 1978.

The following documents are forwarded in connection with the Commission's review of the subject application:

(1) applica-tion of August 14,1979 (Appendix A) and (2) copy of proposed license (Appendix B).

NMSS Technical The proposed export of depleted uranium may be exempted from Review:

IAEA safeguards coverage because of its non-nuclear end use.

While it seems likely that this material will be exempted from IAEA safeguards, NMSS has no information on whether or not this will occur.

The source material to be exported will be processed solely at NUKEM, where a facility attachment is in force, if applicable.

If the material is to be handled outside IAEA safeguards, it will.have to be stored and processed separately from safeguarded material, especially the high enriched uranium which is regular-ly processed there.

The presence of resident inspectors should provide added assurance that such segregation will be maintained.

To the extent that most of the material will be in storage at NUKEM at any given time, item accounting and control will pre-vail. Accounting for material being processed should be straightforward because the processing operation is not expected to be complex. Accordingly, NMSS does not believe that the proposed export will cause serious safeguards problems at NUKEM.

With regard to physical security, NMSS notes that exports of depleted uranium for non-nuclear end uses are not subject to the export licensing criteria of Section 127 of the Act and 10 CFR Part 110.42.

Recommendation:

That the Commission authorize the issuance of the proposed license to Nuclear Metals, Inc.
