NOTICE OF PREHEARING C0h7ERENCE AND EVIDENTIARY HEARING (August 21, 1979)

Notice is hereby given that a prehearing conference auther-ized by 10 CFR 52.752 will be held en September 20 and 21,1979, at Room 303, Cartwright Center, of the University of Wisconsin at La Crosse, La Crosse, Wisconsin 5460'l.

The conference will

commence at 1 p.m. on Thursday, September 20 and continue at 9 a.m. on Friday, September 21, 1979.

It will adjourn no later than 3 p.m. on September 21.

The conference is being convened to discuss the motions for su==ary disposition which have been filed by the Dairyland. Power Cooperative (Applicant) and by the NRC Staff in this proceeding, as well as other =atters specified in 10 CFR 52.752(a).

(At the conference, the parties =ay also be asked cuestiens related to the enviren= ental cententiens in the engeing Operating license proceeding.)

Prior to the conference, en the nc=ing of Septecher 20, the 3 card wishes to tcur the facility, and partic-ularly the spent fuel pool.

The 3 card requests the Applicant 1027 249 7909250 $ e2 bg g,

to make arrangements for the 3 card and parties to partic'.pate in such a tour.

Notice is also given that, to the extent that the foregoing

=otions for su=ma:7 disposition are not granted, the evidentiary hearing in this proceeding will coccence at 9:30 a.m. on Tuesday, October 2, 1979.

To the extent necessary, further sessions will be held on October 3-5, 1979, beginning ' at 9 a.m.

The hearing will be held at Hall of the Presidents, Cartwright Center, of the University of Wisconsin at La Crosse, La Crosse, Wisconsin 54601.

The hearing will be conducted by an Ato=ic Safety and Licensing Beard consisting of Dr. George C. Anderscn, Mr. Ralph S.

Decker, and Mr. Charles Bechhoefer, Chairman.

A Notice of Opportunity for Hearing in this proceeding was published on May 25, 1978 (43 Fed. Reg. 22462).

A petition for leave to intervene filed by George R. Nygaard, Mark Bur = aster, and Anne K. Morse on behalf of the Coulee Region Energy Coalition was subsequently granted and a Notice of Hearing was published on August 4, 1978 (43 Fed. Reg. 34565).

The Board intends to render its decision on the s"- ary disposition notions no later than the conclusion of the prehearing conference.

For issues, if any, upon which a ruling not to dismiss has been made by Septe=ber 12:

In the case of the Applicant and Staff, copies of direct testimony for all three Board members are requested to be hand-delivered to the office of the Chairman in Bethesda, MD.

(Additional copies should also be served on the Board members through nor=al service channels.)

Any person who has not been admitted as a party to this pro-ceeding may request permission to make a limited appearance pur-suant to the provisions of 10 CFR 52.715(a).

A person making a limited appearance =ay make an oral or written statement on the record.

He or che does not becoce a party but may state a position and raise questions which he or she would like to have answered, to the extent that the questiens are within the purview of =atters which =ay be considered in a license acendment proceeding of this type.

Limited appearances will be permitted at both the prehearing conference and, if one is held, the evidentiary hearing, within 1027 251

At the prehearing conference, such statenents will be heard en September 21, 1979, after ccepletien of the formal business of the conference.
