This refers to the inspection conducted by Mr. R. A. Caldwell of the Region IV

Office en July 12-13, 1979, of activities authorized by NRC License No. R-83

for the Nuclear Science Center and to his discussion of the findings with

members of your staff at the conclusion of this inspection.

The areas examined during this inspection was your program for protecting

against industrial sabotage and safeguarding special nuclear caterial pursuant

to applicable provisions of 10 CFR 50, " Licensing of Production and Utilization

Facilities"; Part 73, " Physical Protection of Plants and Materials"; and

specific requirements of NRC License No. R-83.

Within this area, the inspect-

ion consisted of selective examinations of procedures and records, interviews

with personnel, observations by the inspector and review of the Physical

Security Plan for the Nuclear Science Center.

During this inspection it was found that one of your activities was not

conducted in full compliance with NRC requirements, as set forth in the Notice

of Violation, enclosed herewith as Enclosure 1.

This notice is sent to you

pursuant to the provisions of Section 2.201 of the NRC's " Rules of Practice,"

Part 2, Title 10, " Code of Federal Regulations." Section 2.201 requires you

to submit to this office, within 20 days of your receipt of this notice, a

written statecent or explanation in reply including:

(1) corrective steps

which will be taken, and the results achieved; (2) corrective steps which

will be taken to avoid further noncompliance; and (3) the date when full

coapliance will be achieved.

We are concerned about the implementation of your program for management

control of your licensed activities that permitted this item of noncompliance

to occur particularly since it is a repeat item.

Consequently, in your reply

you should describe, in particular, those actions taken or planned to improve

the effectiveness of your manageacnt control of the requirements of your

license.

This additional response on your part is in lieu of stronger enforce-

ment action available to us, and your response will be the basis for developing

the need for possible further action.

In accordance with Section 2.790(d) of the NRC's " Rules of Practice," Part 2,

Title 10, Code of Federal Regulations, documentation of findings of your

control and accounting procedures for safeguarding special nuclear materials

and your facility se.urity procedures are exempt from disclosure; therefore,

the inspection report will not Le placed in the Public Document Room and will

receive liaited distribution.
