7590-01 UNITED STATES NUCLEAR REGULATORY COMMISSION DOCKET NO.56-333 P0'.s'ER AUTHORITY OF THE STATE OF NEW YORK NOTICE OF ISSUANCE OF AMENDMENT TO FACILITY OPERATING LICENSE The U. S. Nuclear Regulatory Commission (the Cor. mission) _has issued Amendment No. 47 to Operating License No. DPR-59, issued to the Power Authority of the State of New York, which revised the license for operation of the James A. FitzPatrick Nuclear Power Plant (the facility) located in.

Oswego County, New York. The amendment will become effe:itve twenty days after issuance, unless a hearing has been requested.

The amendment adds a license condition pertaining to the completion of facility modifications to improve the fire protection program.

The licensee's submittals comply with the standards and requirements of the Atomic Energy Act of 1954, as amended (the Act), and the Commission's rules and regulations. The Conmission has made appropriate findings as required by the Act and the Commission's rules and regulations in 10 CFR Chapter I, which are set forth in the license amendment.

Prior public notice of this amendment was not required since the amendment does not involve a significant hazards consideraticn.

The Commission has determined that the issuance of this amendment will not result in any significant environmental impact and that pursuant to 10 CFR 551.5(d)(4) an environmental impact statement, or negative declaration and environmental impact appraisal need not be prepared in connection with issuance of this amendment.

REQUEST FOR AMENDMENT FACILITY OPERATING LICENSE DPR-70 UNIT NO. 1 SALEM NUCLEAR GENERATING STATION DOCKET NO. 50-272 On May 9, 1979, we submitted a requect to amend certain portions of the Environment Technical Specfications (our reference LCR 77-12B) which consolidated other requests made over a period of approxi-mately 18 months.

The request also introduced several new adminis-tratjvechangesandarequesttoincreasethecondenserdeltatto 18.5 F from 16.5 F.

Mr. William Ross informed us on August 14, 1979 by telephone that these newly requested changes would require sub-mittal of a Class III fee because they had been made after the ef-fective date of 10CFR 170.22 We, hereby, enclose a check for the amount of $4,000. 00.
