POWER AUTHORITY OF THE STATE OF NEW YORK DOCKET NO. 50-333 JAMES A. FITZPATRICK NUCLEAR POWER PLANT AMENDMENT TO FACILITY OPERATING LICENSE Amendment No. 47 License No. OPR-59 1.
The Nuclear Regulatory Commission (the Commission) has found that:
A.
The submittals by Power Authority of the State of New York (the licensee) dated October 23, October 27, and December 21, 1978 and February 8, Marc:i 7 and May 7,1979 comply with the standards and requirements of
'ne Atomic Energy Act of 1954, as amended (the Act), and the Commission's rules and regulations set forth in 10 CFR Chapter I; B.
The facility will operate in conformity with the provisions of the Atomic Energy Act of 1954, as amended, and the rules and regulations of the Commission; C.
There is reasonable assurance (i) that the activities authorized by this amendment can be conducted without endangering the health and safety of the public, and (ii) that such activities will be conducted in compliance with the Commission's regulations.
D.
The issuance of this amendment will not be inimical to the common defense and security or to the health and safety of the public; and E.
The issuance of this amendment is in accordance with 10 CFR Part 51 of the Commission's regulations and all applicable requirements have been satisfied.

Accordingly, the license is amended by adding paragraph 2.C(3) to read as follows:

Fire Protection The licensee may proceed with and is required to complete the mod-ifications identified in Tables 3.1 and 3.2 of the NRC's James A.
FitzPatrick Safety Evaluation Report (SER), Fire Protection Review, dated August 1, 1979 These modifications shall be completed in accordance with the schedule in Tables 3.1 and 3.2 of the SER or supplements thereto.

. Fucther, the Power Authority of the State of New York shall, prior to implementation, provide for Commission review and obtain Comission approval of the final design of modifications as indicated in section 3.1 of the Safety Evaluation Report.
Except for the modifications described in the approved fire protection plan and approved as a result c,f Commission review of the James A. FitzPatrick Nuclear Plant Fire Protection Program, the Power Authority of the Sti.:e of New York is authorizad to make changes to the Program without prior Commission approval provided that such changes do not result in a decrease in the effectiveness of the Program.
The licensee is required to implement the administrative controls identified in Section 6 of the SE. The administrative controls other than pre-fire strategy plans shall be in effect by October 1,1979.
Pre-fire strategy plans are to be effective by January 1, 1980.

This license amendment becomes effective as of August 21, 1979.
