  • This is in response to your letter 79ESG-6218 dated June 21, 1979.

In this letter you describe certain R&D work involving irradiated special nuclear material.

We have determined that the proposed R&D work is within the intent of 10 CFR 70.51(e) and that no additional information is required fror you at this time. We do wish to point out that should this R&D work prove successful, the follow-up production type activity will require revisions to your Fundamental Nuclear Material Ccatrol Plan.

It has been established that your letter dated June 21, 1979 contains information of a type specified in 10 CFR 2.790(d). Accordingly, pursuant to Section 2.790(d)(1), such information is deemed to be commercial or financial information within the meaning of 10 CFR 9.5(a)(4) and shall be subject to disclosure only in accordance with the provisions of 10 CFR 9.12.
