Dear Mr. Poester:

WOLF CREEK GENERATING STATION, UNIT NO. 1 It 15 our understancing that there may be additional cwnership participants in th> captioned nuclear unit.

Pursuant to 550.80 and/or 350.90 of the Ccmaission's Rules and Regulations, as appropriate, any amendment of a license or construction permit or any transfer of a license must fully discuss the changes proposed and follow as far as applicable the form prescribed for original applications.

Ir.cluded with the material that must be submitted to ef"ectuate either an amendment or a transfer when new participants are being added to a license or construction permit is the information required in 150.33a of the Ruias and Regulations.

There is an informal agr'eement between the Department of Justice and the Nuclear Regulatory Ccmmission that coly participants planning to cwn more than 80 MWe of a nuclear unit need to submit the entire ant.1; rust inforTation specified in Appendix L of 10 CFR (part 50) unless specifically requested.

In the event that an entity plans to cwn between 20 MWe or 3C MWe of a nuclear unit only the answer to questicn No. 9 in Appendix L of 10 CFR (part 50) need bc.ai u.ed.

In addition, no antitrust informaticn is requir2d for any entity that plans to cwn less than 20

."'..'e of a nuclear unit unless specifically requested.

In order to expedite tha prccessing of either an amendment or a transfer, it is suggested that the antitrust information for each new participant should be submitted to the Commission through you as the lead applicant.

9 Mr. Glenn Koester July 17, 1979 The Attorney General has a statutory requirement to furr.ich antitrust advice to the Commission on the new owners within six months af ter receipt of the antitrust information.

Cur review and notice requirements require approximately an aduitional two months to process the antitrust information and Attorney General's advice.

We therefore urge you to supply the Appendix L information as socn as it is reasonably certain that additional c.<ners will be participating in the plant.
