Be rry General Manager and Chief Engineer Power Authority of the State of New York 10 Columbus Circle New York, New York 10019 Dear Mr. Berry-By letter dated March 16, 1979 you briefly outlined, and requested staf f con-currence of, your planned course of action at the James A. FitzPatrick Nuclear Power Plant.
With regard to the Connission's order dated March lj,1979 you were directed to place the FitzPatrick Plant in a " cold shutdown condition" until fure.her Order of the Commission.
The Order did not differentiate between " Cold Shutdown" an f
" Cold Condition" as defined in the FitzPatrick Technical Specifications.
These det initions do not cply to the Order and the cold shutdown condition specified in the Order is defined as:
(1) the Reactor Mode Selector Switch in the Shutdown Mode position, and (?) the reactor coolant temperature f 212 F.
Please be advised that all activities conducted during the time the Order is effective should be reviewed in accordance with Technical Specification Section 6.5, " Review and Audit".
The Plant Operating Review Committee should deternine that testing and naintenance, considering the deficiencies identified in the Order, do not involve an unreviewed safety question pursuant to 10 CFR 50.59.
