SECY-78-13C - Petition for Rulemakinc By the Public Interest Research Groua ET. AL.

(PRM 50-22 to Recu1re Bondina of Nuclear Pcwer Plant cDerators to Ensure Deccmmissionina (CONSENT CALENDAR ITEM) 1.

The Comission, by a vote of 4-0*, denied the petitioners' request to initiate rulemaking now to implement the specific decommissioning funding plan of requiring nuclear power plant operators to post surety bonds to cover decocmissioning costs. To the extent that petitioners' request asks the Comission to reconsider the adequacy of its regulations on decomissioning, their request is granted, but a decision as to the specific method or methods for funding decomissioning is deferred. (SD) 2.

The Cornission requested that:

the attached revised Federal Register Notice be prepared for publication in the Federal Recister; (50) (SECY Suspense: 5/29/79) b.

appr0priate Congressional Comittees be informed of this action; (SD/0CA) (SECY Suspense: 5/29/79) c.

the petitioners be informed of this action by letter to be prepared for the Secretary's signature; (SD)(SECY Suspense: 5/29/79) d.

an appropriate press release be issued when the response to the petition is filed with the Office of the Federal Register; (SD/0PA)(SECY Suspense: 5/29/79) e.

a respense to Congressman Drinan regarding the dispositicn of this petition and the cencerns expressed in his letbr of Septem::er 28, 1978 be submitted for the Chairman's signature wicin ten working days afar the response to the petition is filed with the Office of the Federal Register.

Procosed Order in the Matter of Arkansas Power & Licht Company, Arkansas Nuclear One, Unit 1 The Comission, by a vote of 3-0*, approved the Order which confirm agreements reached between the NRC staff and the licensee on actions necessary to provide added reliability to the reactor system to respond safely to feedwater transients.

The Order would become effective imediately on issuance for an indefinite period until the actions described in the Order have been satisfactorily completed.
