This office has received a copy of your application notarized July 2,1979 and transmitted by letter dated July 5,1979 from Le30euf, Lamb, Leiby &

NacRae.

The application was filed with the Office of Nuclear Reactor Regulaticn (0WRR) for review and approval of prooosed cnanges to Section 2.3 of the Technical Specificaticns (TS) of Facility License DPR-40 for Fort Calhoun Unit No. I regarding exclusicn of exercising tests of certain valves during piant operatien.

A license amendment fee pursuant to 10 CFR 170.22 was not forwarded with your applicatico because you determined that it was exempt frcm fees on the basis that it was requested by letter dated '!ovember 22, 1976; i-intended to simplify or clarify the TS; has only minor safety significance; and is issued for the convenience of the Commission.

Footnote 2 to Section 170.22 does provide for exemoticn of certain applications frcm the fee requirements wnen thej meet the criteria set forth therein as identified in the above paragraph, hcwever, applicaticns required to comoly with Commission regulations and guidelitas, or license and Technical Scecifi-cation (TS) conditicns are not ccnsidered to be required for Ine convenier.ce of the Commission.

Commissicn regulations, guides, and license conditions are establisned for the pur;cse of enhancing the safe oceraticn of nuclear facilities and not for tne convenience of tne Commission.

It is recognized that some of these required 3cplications do, in part, result in clarification and/or sicolification of tne license cr TS, but that is generally only coinci-dental to the safety issue.

Based on guidance frcm the CNRR staff as a result of their preliminary revicw of your application, it is our uncerstanding that your aoplication involves review of a safety issue and it is rot for tne ccnvenience of tne Comnission.

As such, it is not exemot from the fee requirements of Secticn 170.22.

It is requested that a Class III amendment fee of 34,000 be forvarded to tnis office.
