This refers to your letter dated May 8,1979 requesting withdrawal of your Quality Assurance program which was submitted on August 7,1978.< The withdrawal appears to be based on your assumption that Texas Instruments does not deliver radiuactive material to a carrier for transport under the general license provisions of 10 CFR 971.12.
However, we are aware that shipments of licensed matarial are being made from your facility by the Department of Energy. This practice does not appear to be in accord with NRC regulations.
Since Texas Instruments is an NRC licensee, shipments of radioactive material being made from your facility must be made in full compliance with 10 CFR Part 71, including use of package designs which have oeen approved by the Comission, where appropriate.
In addition, Part 71 requires Texas Instruments to have a Quality Assurance (QA) program approved by the Comission. Therefore, please respond to our letter of April 27,1979, which concerns your QA progra3, by August 10, 1979, and register in accordance with 10 CFR 371.12 prior to making any additional shipments from your facility in packages containing more than a Type A quantity of radioactive material (10 CFR 571.7) or containing fissile material in excess of 10 CFR 5571.9 and 71.11.
