This office has received a copy of your letter dated March 29, 1979 (LAC-6184),
which transmitted Report 1ES-81A0033 "LACBWR Rod Drop Probability Study" to the Office of iluclear Reactor Regulation (0:1RR).
The report relates to the La Crosse Boiling Water Reactor operated under Facility License !!o. DPR-45.
It is our understanding, based on preliminary guidance from the 0:1RR Staff, that the subject report requires review of a safety issue and subsequent issuance of a letter and/or evaluation setting forth the results of the staff review.
As such, your March 29 filing is subject to the fee requirements of 10 CFR 170.22 and is categorized as a Class III action.
Since rod drop is a safety issue, your filing is not exempt from fees under the provisions of Footnote 2 to 10 CFR 170.22 although it was requested by the Commission's staff.
It is requested that your company promptly fonvard the Class III fee of $4,000 to this office.
If after the final evaluation of your fiarch 29 filing it is determined that it was incorrectly classified, you will be refunded any over-payment or billed for any additional amount due.
