This refers to your letter dated May 14, 1979, regarding the retention of records by U. S. Nuclear, Inc., Oak Ridge, Tennessee.

In our letter to V. S. Nuclear, Inc., of January 3,1978, which you refer to, we advised them that in the ever.t U. S. Nuclear, Inc. ceases to exist as a corporate entity, these records should be transferred to NRC in accordance with instructions that will be given by NRC at that time.

It is our understanding that U. S. Nuclear, Inc. may cease to exist as a corporate entity within the next year. At that time we will instruct U. S. Nuclear, Inc. regarding the transfer of records to NRC.

Until that time, however, they are responsible for maintaining the records.

With regard to your referer.ce to the April 20, 1978 inspection report, the records referred to as having been transmitted to NMSS are copies of specific survey records which the licensee sent to us so that a determi-nation could be made as to whether or not decontamination of the facilities met our decontamination guHelines. A final decontamination survey is now being scheduled.

Please note that in many cases the time for retention of records by NRC is set by statute.

If American Nuclear Insurers require that the records be available until December 31, 1988, perhaps it would be desirable for you to maintain copies of these records.
