tiOTES O!! CONFERENCE CALL OF APRIL 23, 1979 1.

Participants:

Chairman Wolf Dr. Callihan Dr. Cole Stephen Lewis, NRC Staff Counsel Fox Trowbridge, Licensee's Counsel Sherwood Zimmerman. Technical representative of CP&L 2.

The Call was placed by Mrs Lewis, at the request of Chairnan Wolf.

Dr. Cole asked the Staff and Licensee for information on the pipe stress reanalysis conducted for Robinson. Both parties supplied the Board with the informaticn available. Tne Staff agreed to trans-mit promptly to the Board the informaticn which it has receivec to date and to supply the Board with its evaluation upon its completion.

The Board indicated that it would be reviewing SER Supplement 2 closely to determine whether it had any further questions of the Staff and whether a further evidentiary session would be necessary to respond to any further questions it might have.

Dr..Callihaa raised the question of the implications of the Tnree Mile Island 2 incident for this proceeding.

Mr. Trowbridge comented that an increase in power level from 2200 lNt to 2300 Mwt at Robinson would not have any significant bearing on a fMI 2 type of incident, should one occur at Robinson.

Mr. Zimmerman advised the Board that CP&L's present refueling outage is scheduled to end on May 20 and that CP&L would like to be able to return to power at 2300 Mwt.

The Board asked Staff counsel whether the Staff w ' presently Dre-pared to issue the requested amendment should the Board authorize its issuance. Staff counsol indicated that he would have to con-sult with appropriate Staf. management to determine its present

position, 9.

The Board indicated that it wouid be willing to consider Supplement 2 on an. expedited Dasis consistent with attempting to reach a decision in advance of May 20.

In order to reach a determination, however, of whether the amendment should be authorized, tne Board requested a statement frca the Staff as to whether the facility, operating at.

2300 Mwt, would comply with all of the Commission's rules and regula-tions and whether there is reasonable. assurance that the operation as proposed can be conducted without endangering tne public health and safety.

10. The Board also asked the Staff to clarify what items which cear upon the operation of Robinson remain ope,s.
11. The Board indicated that the partles could file whatever proposals (in motion or other form) which they wanted to make with respect to the disposition of the proceeding.
