STIPULATION REGARDING CERTAIN SC CONTENTIONS I.
Technical and legal representatives of the Applicant, the NRC Staff, and Suffolk County (SC or County) have met on March 30, April 20, May 2 and today in order to facilitate informal discovery by SC, as well as to resolve or particularize certain SC contentions.
As a result of these meetings, the Applicant, Staff and County stipulate that:
A.
The following SC contentions will ce pursued no further in this proceeding either because the pertinent County concerns have been resolved or because they will be covered in other SC contentions:
4a (ii), 4a(i:1), 4a (x), 4a(xvil), 7a(_),
7a(vi), 7a(vil), 12a (li), 12a (viii), 14a, 17a(1), 17a (11).

SC having agreed to drop contention 7a (vi), the 1 -
Applicant agrees to meet the following concitions /:

to these or any future conditions, SC does n.ot waive its right to change its position from that of a neutral intervenor to one opposing the application.

Once every five years, the Applicant will:
a.
Verify the torque on the nuts securing the spent fuel pool hold-down plates, and b.
Visually check the accessible portions of the rack hold-down assemblies for corrosion.
2.
The Applicant will establish a maximum permissible leakage rate into the spent fuel pool leakage collection system.
C.
SC contention 4a(vii) and 7a (ii) hate been combined and will be restated in a subsequent stipulation.
TL.
The parties to this stipulation request that the Board accept the agreements set out in Part I above.
III.
There will be contintiing efforts by tne Applicant, Staff, and County to resolve or adequately particularize -he remaining SC contentions.
The Board will be informed of the re sults of these efforts.
