) 110 MOTION OF THE COMMONWEALTH OF MASSACHUSETTS FOR ADDITIONAL HEARING DATES AND FOR A JUNE 29, 1979 DEADLINE FOR FILING TESTIMONY ON THE "NEED FOR POWER" ISSUE The Commonwealth of Massachusetts hereby moves that the ,

Atomic Safety and Licensing Board (the Board) grant additional hearing dates and set a June 29, 1979 deadline for filing of testimony by all parties on the "need for power" issue. The Commonwealth of Massachusetts states as its reasons therefore as follows:

1. The Board ordered on May 9, 1979 that the "need for power" issue would be reopened at the hearing scheduled to ccmmence on May 24, 1979.
2. As of today, the Board aas only scheduled ,

a total of 5 1/2 hearing days between May 24, 1979 and June 1, 1979, to hear all remaining issues in this matter.

3. Besides the "need for power" issue, sub-stantial additional matters will have to be heard during the May 24, 1979 to June 1, 1979 hearings. Principal among these other 311 175 V67 -

issues are the " financial qualifications" issue and the " alternate sites" issue; several additional matters may also be heard during these hearings.

4. The Commonwealth of Massachusetts has been informed that the Nuclear Regulatory Commission Staff will not be able to file its written testimony on the "need for power" issue by May 18, 1979, the last day which is at least 15 days before June 1, 1979.
5. The Commonwealth of Massachusetts will not be able to submit written testimony on the "need for power" issue by May 18, 1979, but rather would have to offer oral testimony at the May 24, 1979 to June 1, 1979 hearings if the "need for power" issue is to be heard at that time.
6. It is unlikely that there will be adequate time during the May 24, 1979 to June 1, 1979 hearings to resolve all outstanding issues.

WHE REFORE , the Commonwealth of Massachusetts moves that the Board schedule additional hearing days and set a deadline of June 29, 1979 for all parties to file testimony on the "need for power" issue.
