AGRED r4T REGARDING DISCLOSURE OF C0tTFIDENTIAL CCMMERCIAL INFORMATION A. Suffolk County (SC' or County) is a party to the above-captioned operating license proceeding. The County has retained a technical consultant to assist in this proceeding.

B, O e Long Island Lighting Cocpany (IILCO) has engaged C?neral Electric Corporation (GE), a non-party in this proceeding, to supply the nuclear steam supply system for the Shoreham Nuclear Power Station.

C. SC has requested that its counsel and/or technical con-sultant be permitted to inspect the follcwing GE documents.

1. List of Itens fret the Nuclear Reactor S udv (Reed Report) Identified in 1975 by Safety ' and Licensing for Consideration as " Reportable Defi-ciencies" under Section 206 of the Energy Reor-ganiration Act of 1974 (dated March 22, 1973)
2. St-- ary cf Status of Itecs fren the Nuclear Re-actor Study (Reed Repert) Identified in 1975 by Safety and Licensing (prepared May 1973)

cial information and to be custc=arily held in confidence. .

D. GE is willing to =ake the docunents available to SC's counsel and its technical consultant (hereinafter "Signators")

to inspect, take notes, and request copies of any pages, which will be =ade by GE, provided that the infor:ation in those docu-cen:s, notes, and copies (hereinafter "inforqation") will be used for the lini:ed purposes and will be treated in a confiden-tial =anner as provided belcw.

E. In consideration of the disclosure of the infornation by GE, the Signators agree as follows:

(1) Signatorr, will inspect the documents, take any notes, and receive any ecpies La strict confidence and secrecy.

(2) Signators will,use the information only (a) for the purposes of discovery and preparation of testi=cny in connection with SC Contention 3a in the above-captioned proceeding, and (b) in testimony as documentary evidence, in cross-examination, and for other legiti= ate evidentiary purposes in connect on with SC Conrencion 3a. (4) Signators will safeguard and hold in strict confi-dence the infor=ation, as well ar. all evaluations, data, or notes =ade in connection with the infer =ation in accordance with paragraph (3) above.

(7) Signators =ay not assign this Agreement.

(8) Signators =ake no a6nission as to whether the in-for=ation disclosed by GE is, in fact , confidential cc==ercial infor=a ion, but Signators will treat the infor=ation on a con-fidential basis.
