Dear Mr. Hand:

In an updated pleading postmarked August 2, 1978, Suffolk County (SC or County) sought to obtain two documents pertaining to General Electric's Reed Report. The two documents, which SC acknowledged had been determined by the NRC Staff to contain con-fidential co==ercial information, were a list of safety-related items discussed in the Reed Report and a su==ary status report of those items. The Applicant's August 17, 1978 reply stated that these documents would be made available to SC. The Applicant also provided a protective agreement for the County's counsel and technical ecnsultant to sign indic.ating that they would trea the documents as proprietary and not disclose their content to any-one who had not signed the protective agreement.

SC's letter of September 19, 1973 indicated general satis-faction with the protective agreement and recuested that it be expanded to include GE Topical Report NZD-21021-?, entitled "Tes:

to the County and forwarded the protective agree =ent v th the appropriate revisions.

At a meeting on April 20, 1979, counsel for SC handed the protective agreement to counsel for the Applicant. The last page of the agreement had been revised to add a new paragraph (10) and had been cigned by Messrs. Like, Hand and Goldsmith.

The agreement was sent to GE for its signature. A copy of the signed prot-ctive agreement appears as Enclosure A.

Under the terms of the protective agreement, the following documents are transmitted to SC's counsel:

1. " List of Items for the Nuclear Reactor Study (Reed Report) Identified in 1975 by Saf'ty and Licensing for Consideration as ' Reportable aficiencies' under Section 206 of the Energy Reorg e ! ' ation Act of 1974,"
