X-ENERGY, LLC - ACCEPTANCE OF THE QUALITY ASSURANCE PROGRAM DESCRIPTION FOR DESIGN CERTIFICATION OF THE X-ENERGY XE-100 REACTOR (CAC NO. 00431)
Dear Mr. Bowers:
By letter dated July 31, 2019, X Energy, LLC (X-Energy), submitted for U.S. Nuclear Regulatory Commission (NRC) staff review its quality assurance program description for the design certification of the X-Energy Xe-100 reactor (Agencywide Documents Access and Management System Accession No. ML19213A059). The NRC staff has performed an acceptance review of the quality assurance program plan description and found that it contains sufficient information to enable the staff to complete a detailed technical review. Notwithstanding the acceptance review, the NRC staff may require additional information to complete the detailed technical review. If needed, the NRC staff will request this information by separate correspondence by November 2019.
Based on the acceptance review, the NRC staff expects to issue a safety evaluation by the end of March 2020. This date could change as a result of several factors, including the need for and timeliness of responses to requests for additional information, unanticipated changes to the scope of the review, and unsolicited supplements to the topical report. Additionally, the staff will notify the Advisory Committee on Reactor Safeguards (ACRS) of this program description and may choose to discuss it at an ACRS meeting, which could impact the staffs schedule for issuing the final safety evaluation.
If the forecasted completion date of the review or interim milestones change, the NRC staff will notify X-Energy in writing of the new date and explain the reason for the change. The NRC staff estimates that the review will require approximately 150 staff hours, including project management time.
Title 10 of the Code of Federal Regulations 170.21, Schedule of Fees for Production and Utilization Facilities, Review of Standard Referenced Design Approvals, Special Projects, Inspections, and Import and Export Licenses, requires approvals and pre-application and licensing activities to be subject to fees based on the full cost of the review. X-Energy did not request a fee waiver for the cost of this review; therefore, the NRC will bill staff hours to X-Energy accordingly.
