Dear Chairman Ramirez:
I am writing to inform you of the U.S. Nuclear Regulatory Commissions (NRCs) receipt of the Texas Band of Yaqui Indians filing of the Tribal Response Form - Cultural Resource Considerations for the Interim Storage Partners LLC (ISP) License Application for a Proposed Consolidated Interim Storage Facility for Spent Nuclear Fuel in Andrews County, Texas. By that filing, the Texas Band of Yaqui Indians indicated interest in consulting on the project and to be contacted to discuss further their interests.
In a letter dated May 6, 2019, addressed to you concerning ISPs license application, the NRC stated that, pursuant to 36 CFR Paragraph 800.2(c)(5), certain individuals and organizations with a demonstrated interest in the undertaking may participate as consulting parties due to the nature of their legal or economic relation to the undertaking or affected properties, or their concern with the undertaking's effects on historic properties. I am writing to you also to seek further information concerning the nature of your Tribes interest in the project (i.e., undertaking) relative to 36 CFR 800.2(c)(5). In other words, is your Tribes interest due to legal or economic relation to the undertaking or affected properties or is the interest due to concern with effects on historic properties? In answering this question, the NRC would appreciate any supporting information or discussion that you consider appropriate to share.
Please note, that in accord with NRC policy, correspondence provided to the NRC, including emails, may be made publicly available. Therefore, the NRC recommends that you avoid including any information that you do not want to be publicly disclosed.
