NOTIFICATION OF AND REQUEST FOR CONSULTATION REGARDING INTERIM STORAGE PARTNERS LLCS PROPOSED CONSOLIDATED INTERIM STORAGE FACILITY FOR SPENT NUCLEAR FUEL, IN ANDREWS COUNTY, TEXAS (DOCKET NUMBER: 72-1050)

Dear Dr. Pappas:

The U.S. Nuclear Regulatory Commission (NRC) received a license application from Waste Control Specialists LLC (WCS), on April 28, 2016, to construct and operate a consolidated interim storage facility (CISF) for spent nuclear fuel, in Andrews County, Texas. On January 26, 2017, NRC found the WCS application acceptable for detailed technical review.

On April 21, 2017, WCS requested a temporary suspension of NRCs review of the license application. On June 8, and July 19, 2018, Interim Storage Partners LLC (ISP), a joint partnership between WCS and Orano USA, requested that NRC resume its review; and provided a revised license application. On August 21, 2018, the NRC staff determined that the revised application contained sufficient information for the NRC to resume its review. Maps showing the proposed project location are provided in the enclosure.

The NRC is preparing an Environmental Impact Statement (EIS) to document its independent assessment of the potential impacts from the construction, operation, and decommissioning of the proposed CISF. The NRC is preparing the EIS in accordance with its regulations at Title 10 of the Code of Federal Regulations (10 CFR) Part 51, Environmental Protection Regulations for Domestic Licensing and Related Regulatory Functions, which implement the provisions of the National Environmental Policy Act of 1969 (NEPA). In accordance with 36 CFR Part 800.8<

Coordination with the National Environmental Policy Act, the NRC staff is using the NEPA process to comply with its obligations under Section 106 of the National Historic Preservation Act of 1966, as amended (NHPA). The environmental review will also include analyses of potential impacts to historic and cultural resources.

Accordingly, the NRC staff is identifying parties and inviting them to consult with the NRC on this matter. Consultation will include participation in the identification of cultural, historic and archaeological properties within the area of potential effect for the project; assessment of the effects of the proposed action on any such properties identified; and development of alternatives and proposed measures that might avoid, minimize, or mitigate any adverse effects of the proposed action on such properties. The environmental review will include analyses of potential impacts to cultural, historic and archaeological properties and will document the NRC staffs determinations.

J. Pappas 2 Through this letter, the NRC staff initiates consultation under NHPA Section 106 with the New Mexico State Historic Preservation Office regarding the ISP proposed undertaking.

To support the environmental review and implementation of the NHPA Section 106 process through NEPA, the NRC requests that your office provide information, comments or concerns you consider appropriate with regard to cultural, historic or archaeological resources of interest that may be affected by the proposed undertaking. Any information you provide will be helpful in developing the scope and quality of our review in accordance with 10 CFR Part 51.

The NRC also sent out letters to Native American Tribes that may be interested in consulting on the identification of historic properties. We are specifically requesting information on identification of sites that may have traditional religious or cultural significance to Tribes that may be affected by the proposed undertaking.
