ZION NUCLEAR POWER STATION, UNITS 1 AND 2 - ORDER APPROVING TRANSFER OF THE LICENSES FROM ZIONSOLUTIONS, LLC TO EXELON GENERATION COMPANY, LLC AND CONFORMING ADMINISTRATIVE LICENSE AMENDMENTS (EPID L-2018-LLA-0217)

Dear Mr. Sauger:

By letter dated July 24, 2018 (Agencywide Documents Access and Management System

[ADAMS] Accession No. ML18211A303), as supplemented by letters dated January 21, 2019, and February 8, 2019 (ADAMS Accession Nos. ML19028A175 and ML19043A673, respectively), ZionSolutions, LLC (ZS) and Exelon Generation Company, LLC (Exelon)

(collectively, the applicants) submitted an application, pursuant to Section 184 of the Atomic Energy Act of 1954, as amended, and Section 50.80, Transfer of licenses, of Title 10 of the Code of Federal Regulations (10 CFR), requesting that the U.S. Nuclear Regulatory Commission (NRC) consent to the direct transfer of Facility Operating License Nos. DPR-39 and DPR-48 for the Zion Nuclear Power Station, Units 1 and 2, respectively (Zion), and the associated general license to the Zion ISFSI.

Specifically, the applicants requested that the NRC consent to the direct transfer of ZSs ownership interest in, and management authority of, Zion to Exelon. Exelon will assume all of ZSs authority, obligations, and commitments under the licenses and all NRC orders pertaining thereto. The applicants also requested approval of conforming amendments to the licenses pursuant to 10 CFR 50.80 and 10 CFR 50.90, Application for amendment of license, construction permit, or early site permit. Notice of the application was published in the Federal Register (FR) on September 24, 2018 (83 FR 48343). The supplemental letters dated January 21, 2019, and February 8, 2019, provided additional information that clarified the application, did not expand the scope of the application as originally noticed, and did not change the NRC staffs no significant hazards consideration determination.

The NRC staff has completed its review of the Zion license transfer application. Enclosure 1 is the Order, which provides consent to the proposed license transfers, subject to the condition described therein, and approves the conforming license amendments. Enclosure 2 provides the conforming amendments for Zion, which will be issued and become effective at the time the transfer is consummated. Enclosure 3 provides the NRC staffs safety evaluation (SE) related to the preceding actions. The SE will be placed in the NRC public document room and added to the ADAMS Publicly Available Records System Library.

A copy of the Order has been forwarded to the Office of the Federal Register for publication.

In accordance with 10 CFR 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of NRCs ADAMS. The ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html.
