Dear Mr. Ragone:

In your letter of May 22, 1979 to Diairman Hendrie you stated that you understand through the news media that the Nuclear Regulatory Comission placed a moratoritsn for three months on the issuance of new operating licenses and that furth Anna Unit 2 will be affected by this action.

You further indicated that Surry 1 was shut dow1 unnecessarily and request that Surry 1 be returned to service while the reaaining pipe stress calculations are completed.

Since rulings and decisions relating to the fbrth Anna Power Station, Unit 2 could be subject to review by Chairman Hendrie and the other Comissioners, it would not be appropriate for Chairman handrie to coment at this time. Accordi ngly, your letter of May 22, 1979 has been referred to me for response.

As you know, the tRC staff is currently conducting a thorough investigation of the March 28, 1979 incident at the Three Mile Island Power Plant, Unit 2.

This investigation includes studies of the potential design deficiencies in the plant, operator response to the accident including operator errors and/or mi: inter,

pretation of plant instrumentation and all other aspects of the accident whici, might lead to information that would improve the safety of nuclear power plants.

The results of these investigations will also be applied to plants that are currently under construction and for which operating licenses have been applied for but not yet issued such as the fbrth Anna Powr Station, Unit 2.

Any new safety requirements arising from these investigations will be evalue'ed to determine whether they are applicable to the Pbrth Anna Power Station, Unit 2 and will be applied to Unit 2 accordingly.

We recognize that these investigations will delay the issuance of an operatina license for Unit 2 and that a hardship will be placed on the Virginia Electric and Powr Company. Homver, we are proceeding on the basis that primary con-siderution should be given to the public's health and safety and that our in-vestigation of the 'hree Mile Island incident should progress to the point where the implications regarding that incident c.ould be assessed to determine the itpact, if any, on the North Ar na Powr Station, Unit 2.

With regard to the shutdown Order issued on March 13, 1979 for Surry Unit 1, the.lcts available at that time were inadequate to support the continued operation of Sorry 1.

Furthermr.re, in responding to that Order, you did not immediately provide additional factual stress data adequate to support such continued operation.

a Mr. Stanley Racont:, ' resident As you know, we expeditiously established a special review team which has been evaluating the additional data you have subsequently developed, validated and officially submitted on the record.

As of June 4,1979, there still remains some data which you have not yet provided. We continue to stand ready to evaluate the technical bases, as you submit them, that demonstrate the seismic adequacy of your present safety related piping systems and supports including any modifications that may be necessary to remove inadequacies, or any new design bases, that, if acceptable, would eliminate the need for such modifications.

We trust that you will continue to ooperate by supplying the additional data needed to support a restart of Surry 1.

Please advise us if you have any questions regarding this response.
