NRC STAFF MOTION FOR
SUMMARY
DISPOSITION The Appeal Boards in ALAB-540, issued on April 25, 1979, allowed the parties thirty days (to and including May 25, 1979), for the filing of motions for summary disposition as regards twenty-three asserted deficiencies in the Perkins1/ record (Items) advanced by Intervenors Ecology Action of Oswego (Sterling) and Northern Thunder, Inc., (Tyrone) (Intervenors ).
Pursuant to 10 CFR s2.749, the Staf f moves that Intervenors asserted deficiencies 9 and 20 5e dismissed since, as discussed below, they do not raise genuine issues of material fact and may be summarily disposed of by the Appeal Boards as a matter of law.
Item 9 states that:
A very important factor in calculating the radon emissions from mining during the first 1000 years (the period the Staff thinks significant), is the success of the uranium mining industry in sealing or reclaiming nines.
Success is predicated on state laws mandating sealing and reclamation.
However, it is projected a substantial portion of the uranium to supply reactors located in the United States will come from foreign countries.
Indeed, in recently completed hearings before the Wisconsin PJblic Service Commission, Northern States Power Company, one of Tyrone applicants, suggested foreign uranium mav l;e used to power the Tyrone plant.
The possi-bilit, foreign uranium will be use[d] to power either Sterling or Tyrone requires consideration be given to the radon emissions which might be attributable to foreign mines.

Iteu 20 states that:
As pointed out above with respect to mining [ Item 9],
some of the uranium to fuel Sterling and Tyrone may come from foreign sources.
If so, it is reasonable to assume the uranium would be milled ir. a foreign country.
Since tne United States has no jurisdiction of foreign mills, it has no control over the stabilization and isolation of tailings located in foreign countries.
Thus, to the extent uranium for Steriing or Tyrone is milled in foreign countries may be increased.
Information regarding this point should be obtained.
Stripped to essentials, the above Items assert that there is a possibility that foreign uranium may be used to power either Sterling or Tyrone. Because of this possibility, say Intervenorc, the Appeal Boards should hear evidence concerning radon emissions from the foreign mining and milling of uranium.
A review of the records in both these construction permit proceedings fails to disclose any testimony regarding thc source of fuel for either Sterling or Ty ro n e.
That such information is absent from the records is not surprising in view of Union Electric Company (Callaway Plant, Units 1 and 2), ALAB-347, 4 NRC 216, 220-223 (1976).
In that case it was held that Applicants are not required to identify their source of fuel in order to obtain construction permits.
Thus, any consideration of radon emissions from foreign sources would have to be based on an assumption which need not form a part of the record.
Assuming, for the sake of discussion, that a record could be established showing tht+ foreign sources of uranium might possibly be used, in whole or in part, to fuel Sterling or _Tyrone (or any other domestic reactor), radon emissions from mining and milling effects, which take place on foreign soil, and dttendant impacts on the environments of either foreign lands or the United States, need not be considercd in these proceedings.
This is because the 4b0 J9' governnent of the United States does not have jurisdiction over activit its which take place on foreign soil.
Edlow International Company (Agent for the Gosernment of India on Application to Export Special Nuclear Material)
Although set in the context of deciding standing to intervene in a licensing application concerning the export of (domestic) special nuclear material to fuel a foreign reactor, the Comission's Coinion in Edlow is directly applicable to determining whether the two asserted de fi ciencies in the Perkins record, quoted above, should be summarily disposed of by the Appeal Boards.
As noted by the Commission in Ed_ low, the National Environmental Policy Act of 1969 (NEDA) does not have an international reach" The " focus of NEPA is the assessment if the domestic impacts of domestic activities" (Id. at 584-585).
Clea ri y, the mining and nilling o f uraniun on foreign soil cannot be considered a doicestic activity.
Accord'nf.y, asserted deficiencies 9 and 20 cannot, as a natt :r of law, raise any genuine issues of material fact and may be sumari', d i s po s e d o f by the Appeal Beards.
Conclusion For the recsons stated above, the Appeal Soards should sum arily divow of Ir.tervenors ' asserted deficiencies 9 and 20.
