NATURAI., RESOURCES DEFENSE COUNCIL STATEMENT OF FACTS AS TO WHICH THERE IS NO DISPUTE 1.
Duke Power Company does not need approval of transshipment to prevent harm to the public interest -- i.e.,
the Oconee reactors are not in danger of being shut down due to a shortage of spent fuel space.
2.
Duke has a plan to cascade its excess spent fuel from older reactors to newer reactors.which if implemented with present and planned spent fuel storage capacity would provide spent fuel storage and retention of FCR (lyr site) for 13 Duke reactors through 1995.

Transshipment of spent fuel involves higher radiation exposures to workers than use of the on-site spent fuel storage pool and higher radiation exposures to workers than use of an independent spent fuel Jtorage pool at the site for the spent fuel of the reactors at that site.

If there is no permanent waste disposal site avail-able to receive spent fuel from Duke's 13 operating reactors in 1995 (at the rate of approximately 830 assemblies per year),

t-2 Duke vill need to pay the cost to build an AFR, to build on-site storage capacity at each reactor site, or to pay its share of the cost of the AFR owned by the government or a private party.

The Staff has not done an analysis of the Duke cascade program or an analysis of alternatives to it as part of ALARA or NEPA considerations.
6.
It can not be reliably concluded that a permanent waste disposal facility sufficiently large to accommodate the Duke needs will be in place and available for use by Duke by 1995.
