Dear Mrs. Randall:

Thank you for your letter of April 12, 1979, to Chaiman Joseph Hendrie.

It has been referred to me for reply.

I appreciate your concerns for emergency planning in support cf the operation of the nuclear power plants in your area.

You state in your letter that utilities must file an evacuation plan in order to be licensed. Actually, they must file an emergenct plan for the facility and this plan must include some provisions for notifying the public in the vicinity of the plant in an emergency.

Under NRC regulations 10 CFR 50, Appendix E (a copy of which is attached), a licensee has the responsibility to make arrangements with offsite authoritie', whose assistance may be required in an emergency.

Since the licensee has no authority to act offsite, these arrangements typically call for the proper offsite authorities to implement any recommended offsite protective actions, incleding evacuation, if they should ever be necessary.

Currently, the arrangements for these offsite protective measures aie nomally made out to distances on the order of 4-5 miles and since you are farther than that from the fecilities you mention your township was apparently not included in offsite plans.

In addition, most such arrangements are nomally made at the county level rather than at the township level.

The county should then coordinate emergency planning with the township.

In the case of Three Mile Island, Metropolitan Edison filed with the NRC a copy of a letter dated November 18, 1977, from Paul Leese, Civil Defense Directcr of Lancaster County which states that the Lancaster County Civil Defense organization would provide assistance to Metropolitan Edion in support of TMI.

You should also be aware that an NRC/ EPA Task Force published a report in December 1978, entitled " Planning Basis for the Development of State and Local Government Radiological Emergency Response Plans in Support of Light Water Nuclear Pcwer Plants" (NUREG-0396/ EPA-520/1-78-016) which describes a concept of establishing Emergency Planning Zones for emergency planning.

Two zones are described, a plume exposure pathway zone of about 10 miles and an ingestion pathway zone of about 50 miles. The public comment period for this report expired on May 15, 1979.

The NRC and EPA staffs will now consider the comments received and then make recom-mendations to the Comission and the EPA Administrat)r with respect to the concepts described in the report.

You mentioned the rejection by South Carolina of the waste from Three Mile Island for burial at Barnswell in South Carolina.

For your infonnation, I am including a copy of a letter which Governor Richard Riley of South Carolina recently sent to Chairman Joseph Hendrie, and a copy of a letter which Governor Riley also sent to the Washington Post.

The letters are self-explanatory and give the reasons for rejecting the waste.

You suggest that the NRC recomend to the President that a moratorium be imposed on new construction of nuclear power plants and all licensed plants be shut down.

This is not a decisicn which the NRC could make lightly. We would not hesitate to shut down plants which we believe were either unscfe or whose operations were seriously questionable.

I refer, for example, to the recent shutdown of the five east coast plants because of the questionable locations of earthquake faults and to the shutdown of the Babcock and Wilcox plants following the Three Mile Island accident.

In both of these cases the plants will not be allowed to resume operation until we are convinced that it is safe to do so.

Mrs. Randall, I appreciate your concerns.

Emergency planning has not had the priority status within the Federal government and at the State and local government level that I believe it should have had.

But the accident at Three Mile Island is changing that and within the next several months I believe that more emphasis will be paid to this subject by the Comission and by the Congress.
