Concurrently with the dispatch of the IAL to the d licensee, a cc. y of the IAL as issued vill be sent to IE:HQ for in f o rma tion and a cumpleta f'le of such actions. The actions : straightforward state =ent and will not " request" a or " order" the action. h The Immedia te Ac tion Letter vill also be used in those cases { Ehcre the licensee, because of an actual or potential incident or occ u r r enc e involving a threat to the health, safety or interest of the public, or; the, co=on defense and security agrees voluntarily to cc.ne operations until the threat is arrested or until the items of noncompliance or deviations are; properly evaluated and corrected. In such cases, the Tamediate Action Letter will state the prob 1cm as understood and will ~ nake the following or a similar statenent: "Th i s vill confirm the telephone conversation on (da t e) between (the OIE Representative) of this Of fice and (licensee representative and title) of your organiza tion in which (licensee) agreed to cease operations until (specify catters to be evaluated and corrective =casures to be imp l eme n t ed - i.e., inventory is made, catettal is properly accounted an __3 for, and corrective measures have been implemented to preclude further losses)."- = "It was fur ther agreed that (licensee) vill notify Region [ (X) when corrective action has born completed so that the \\ adequacy of such actions can be evaluated before operations are resumed." Lrcediate Ac tion Let ters used to confirm licensee agreenent to corrective action following an SNM inventory discrepancy should not contain ' informa tion tha t should be withht Id as proprietary under 10 CFR 2.790, Normally, the Immediate Action Letter can be written so that it contains no proprie tary,inf,ormation and, therefore, can be disclosed to the public (See At tachmen t.. I). In very unusual' cases, where either the background ~- information that the Regional Of fice believes necessary to include or the description of the c.orrective action the licensee vill take constitutes - proprie,tary information pursuant to 10 CFR 2. 790(d), a different procedure is,necesr.ary to protect the information. In this case, the Immediate Action Letter should be expressed in general language and serve as a transmittal of the more explicit in f o r=a tion. The letter itself should not contain any proprietary information and should be distributed according to nor=al dis-tribution for. correspondence with licenseco. An a ttachment to the letter should contain the necessary details of the agreement as to corrective action and the necessary background inf orma tion.
