Dear Sirs:

This is in reply to your request, dated May 1, 1969, for an exe=p-tion from the provisions of Section 50.10(b),10 CFR Part 50 of the Commission's rules, pursuant to Section 50.12 of the rules, to permit the perfor=ance of certain work at the site of the Three Mile Island Nuclear Station Unit 2 prior to issuance of a construc-tion permit by the Cc=aission.

You state that pouring of concrete for the tendon access gallery, which vill be located below the main contnfment =at, cust be authorized before you can proceed with certain other pre-construction work such as pouring the concrete ssal rat to provide a working sur-face and protect bedrock against weathering at the botten of the reactor building excavation and per it placement of reinforcing bars for the reactor building base slab. You further state that schedulin:;

of the construction of the tendon access gallery is important to permit adherence to your schedule for ccepletion of the plant.

We have examined the supporting infor=atien contained in your request for an exemption and have concluded the granting of an exemptica, pursuant to Section 50.12 of 10 C7R 50, as requested in your letter of May 1,1969, is autherized by law, and vill not endanger life or property or the coc=on defense and securin and is otherwise in the public interest. Accordingly, the Cc==ission hereby authorizes you to ecustruct the tenden access gallery for Unit 2 at the Three S.ile Island Nuclear Station site, as requested in your letter of M.ay 1, 1969, prior to the issuance of a constructicn permit.

Messrs Ritter and Miller I wish to emphasi::e that granting of this exenption shall have to bearing upon the subsequent granting or denial of a construction permit for the proposed Three Mile Island Nuclear Station Unit 2, and any work performed pursuant to this exemption shall be per-formed entirely at the risk of Metropolitan Edison Coc2pany and Jersey Central Power & Light Company.

Furthermore, the granting of this exemption does not constitute an approval of the type or adequacy of the nethod of its installation.
