Congress recently enacted the lational Environ: ental Policy Act of 1969 and the Water Quality Incrovenent Act of 1970 which require agencies of the Federal gover :ncnt to take certain actions with respect to enviren-mental =atters.

Under the provisions of section 102 of the National Environental Policy Act, each Federal agency is required to consult vich appropriate Federal, State, and local agencies concerning major Federal actions significantly aff acting the qmlity of the hu=an environnent and to prepare a detailed statenant concerning, among other thin:;s, the environ nnntal inpact of the proposed action. Wo vill need from you, at the tire of filing of 7our Final Safety Analysis Report, certain inforration to per=it us to prepare the darM1ed environ:aental statenant required by the Act.

Specifically, as provided in the Act, we vill need your co= mats with respect to the following ite=s as they may be affected by the proposed operation of the Three ' tile Island Nuclear Station Unit 2:

a.

the environ = ental i= pact of the propcsed action, b.

any adverse cuvironmental offects which cannot be avoided should the proposal be implemented, c.

alternatives to the propoacd action, d.

the relatienship between local short-tern uses of nan's environment and the saiatenance and enhanecrent of lon;;-

In addition to ths above material, please provide the information indicated on the enclosed list. Scee of the information requested may previous.17 have been supplied in your application, but for completeness, we would like to h. ave all the information you provide that will be used in the%

preparation of the environmental statement contained in a single document.

This report should not be filed as an amendment to your application or as part of the Final Safety Analysis Report but should be filed as a separate report. We would appreciate receiving 150 copies.

After we have received this infornation, we plaa to send copies to the appropriate Federal and State agencias requesting their coments. W.cn concents fron these agencies are received we vill prepare the environ-mental statement required by the Act and send it to the Council on Enviro = mental Quality. A copy of the statement also vill be sent to you and to the Federal, State, and local agencies, and the statarent vill acconpany your application through the Comission's licansing process.

To assist you in understanding the requirements of the National Enviro = mental Policy Act we are enclosing copies of the Act, the Interin Guidelines for Statemnts on Proposed Fed 2ral Actions Affecting the Environment pt:blished by the Council on Environmental Quality, and the proposed revision of Appendix D to 10 CyR 50 of the Cea=issinn's regula-ticas regarding Imple=entation of the National Environmental Policy Act.

The Vatar Quality Improvement Act (copy enclosed) amends cartain sections of the Federal Water Pollution Control Act. This new legislation (see section 21(b)(1) of the amended Federal Water Pollution Control Act) requires applicanto for a construction permit and operating license for any nuclear p,arar plant which will discharge effluents into the navigable vatars of the United States to provide the AEC with a certifica-tion from the State or interstate pollution control agency, or the Secretary of the Interior, as appropriate, that there is reasonable assurance that tha plant will not violate applicable water quality standards. The AEC would generally be prohibited fron issuing any such pernit or licanse without having received this certification.

Where actual construction of the facility hat comanced, or where an application was p==H ng on the date of enactment of the Water Quality Improvement Act, sections 21(b)(7) and (8) of the amended Federal Water Pollution Control Act extand the period of time wherein the OmCE >............... _...
