On April 10, 1973, you wrote to Mr. James P. O'Reilly, Director Regian I, of our Directorate of Regulatory Operations in response to Bulletin No. 73-1 entitled, " Faulty Overcurrent Trip Delay Devico in Circuit Eran'ars for Engineered Safety Systems". Your letter indicated that you would rely on your initial inspection and a follow-up spac4al testing and inspection procedure to affirm that the original e=c cap cracking proble:s in the subject devices la resolved. We have evaluated pa proposed resolution of this problem and do not censider it acceptable. We feel that no compromises should be c:sde on breaker time dalay mach mic a, whose proper operation is essential to ensure the availability of engineered safety-related components during accident condit"' mis.

We do not consider periodie inspection and increased surveillance on installed, and in-service equipment, acceptable to detect manufacturing defects and cn-nl ative material fatigue.

An acceptable resolution of this matter would be to replace all the time delay dashpot end caps which were i=volved in the defective canufacturing process with new caps, whose time delay fu ction is factory tested to the requirements of A3SI C37.17, " Trip Devices for AC and DC Lov Voltage Power Cirenit 3raakars".

An acceptable resolution of this natter must be i= ole-cented before issuance of the operating license for the plant.

Please notify us within thirty (30) days of your intended course of action.
