Oyster Creek Nuclear Generating Station Docket No. 50-219 CFR, Title 10, Part 71, Appendix E On June 30, 1978, Jersey Central Power & Light Company submitted an Operational Quality Assurance Plan Revision to the Nuclear Reactor Regulation (NRR) Branch of the Nuclear Regulatory Commission (NRC). One purpose of this revision was to address the requirements of the Code of Federal Regulations, Title 10, Part 71, Appendix E.
In essence, Jersey Central Power & Light i
Company has committed to implement the applicable portions of its 10CFR50, Appendix B, program to comply with 10CFR71, Appendix E requirements.
Since June 30, 1978, Jersey Central Power & Light Company has been given additional information regarding the intent of the 10CFR71, Appendix E requirements as it relates to the utility's implementation of its responsibilities.
As a result of the NRC Transportation Branch's review of our program and subsequent discussions held on September 6,1979, Jersey Central Power & Light Company has learned that its responsibility, when utilizing NRC licensed shipping packages that are leased / purchased from a vendor with a NRC approved 10CFR71, Appendix E program, is more extensive than originally interpreted.
In addition, it was learned that the requirements of 10CFR71, Appendix E apply only to those packages which are identified in 10CFR71.12.
It also was brought to our attention that submitting the program to NRR was not sufficient to cover the requirement of 10CFR71.51.
In light of the above, Jersey Central Power & Light Company is submitting this letter to the NRC Nuclear Material Safety and Safeguards Branch as required by 10CFR71.51 and is re-emphasizing our basic commitment to utilize those portions of its 10CFR50, Appendix B program that we have determined to be 1403 560 I Pl 7911280 es Jersey Central Power & L;gnt Company is a Memoer of the General Pubhc Ut& ties System

appropriate to a particular task.' # understand that the submittal of this letter fulfills the requirements of 10CFR71.51 and that acceptance of our Operationel Quality Assurance Plan by NRR fulfills your program review requi rements. Finally, we understand that the NRC Nuclear Material Safety and Safeguards Branch will issue a certificate which approves our commitment and allows approximately two months from the date of issue to be in full compliance.
