This office has received a copy of your September 13, 1979 application for amendment to Facility License DPR-59 which you filed with the Office of Nuclear Reactor Regulation (0!!RR).
The appi*cc. tier pre;::es changes to the instrumentation specifications of the James A. FitzPatrick Nuclear Power Plant Technical Specifications (TS).
You stated that no license fee was necessary because the proposed changes are the result of previ-ously approved modifications for the " Vermont Yankee Fix, Boundary Valve Changes, etc."
Based on guidance from the ONRR staff as a result of their preliminary review of your application, it has been determined that the requested action involves consideration of a safety issue that qualifies it as a Class III amendment.
Further, it is our understanding that before the revisions and additions to the TS can be approved for the.~itzPatrick Plant, they must be reviewed by the ONRR staff to determine their accept-ability. On this basis, your application is not exempt from fees.
It is requested, therefore, that you promptly for.vard the Class III fee of
$4,000 to this office.
If after the final evaluation of your application is completed it is determined that it was incorrectly classified, you will be refunded any overpayment or billed for any additional amount due.
