This refers to the special inspection conducted by Mr. M. S. Kidd, Senior Resident Inspectcr ard otners of our Region II (Atlanta) office of Inspection and Enforcement cm Senterroer 25 - October 5,1979, of activities authorized by NRC License too. h3F-4 for tne North Anna facility.

This also refers to the investigation corducted by Mr. C. E. Alderson, Senior Investigator and others an Octcber 2-17, 1975.

T7is special inspection and investigation were conducted to review the circt.mstances surrounding the plant transient and unplanned radioicgical release on Septe-ber 25, 1979.

Our findings were discussed with W. R. Cartwright ard atne re-bers of your staff at the conclusion of the inspection ard ir./estigation.

During the inspection and inves.igation, it was found that certain activities uncer your license ap; ear to % in nonccmpliance with NRC requirements and are listed in the hotice of Violation enclosed herewith as Appendix A.

Due to the significance of tnis 9atter, the enforcement aspects have been escalated from cur Region II cifice to Feadquarters.

During the Headquarters review of item B in the Notice cf /iolatica, it was determined that in addition to the apparent violation of 10 CFR 5).59'o) as indicated in the associated inspection report (Report No. 50-333/75-39), this item was also found to be an apparent violation of 10 CFR 50, Aapendix A, Criterion 13.

This notice is sent to yea pursuant to the provisions of Section 2.201 of the NRC's " Rules of Practice," Part 2, Title 10, Code of Federal Regulations.

Section 2.201 recaires you to submit to this office, within 20 days of your receipt of this notice, a written statement or explanation in reply including:

';cned that members c' yo;r plant staff, including supervisors, were aware that an automatic feature -as routinely disabled as an operating convenience.

The use of a pencil and paper clic cr similar mechanism to provide a control function is not acceptab~ie nor wil' it be tolerated by the NRC for use in the operation of a nuclear power clant.
