confidential manner as provided below.

In consideration of the disclosure of the inforra-tion by G, the Signator agrees as folloos:
'l) _Signator will inspect the doc =ents, and take any notes in strict confidence and secrecy.
(2)
Signator will use t)u infornution only (a) for the purposes of evaluating the faithfulness of G's verbatim extraction, and (b) in consultation with G toward resolving any disputes as to faithfulness of extraction, and (c) during M canura oral arguments tward resolution of any such dis-putes. The information, ii used in whole or in part for any of the above purposes shall be subject to paragraphs (3) and (4) below and shall be presented only during g canera ses-sions before the Board that provide protection against non-disclosure equivalent to that provided under this Agreenunt.

Signator will not photocopy, transcribe, re-produce, or disclose the infonration to any other person or entity who has not executed this Agreemnt.
(4)
Signator will safeguard and hold in strict confidence the infonration, as well as all evaluations, data, or notes made in connection with the infornation in accordance with paragraph (3) above.
(5)
Pestrictions on disclosure contained herein shall not apply to any inforration or mterial:
a.
which can be shown to have men kna.n or used by Signators prior to the date of disclosure to Signators by 2, or b.
which either before or after the date of

disclosure to Signators by G is lawfully disclosed to Signators by an independent third party without restriction on dis-closure on behalf of G, or c.
which either before or after the date of disclosure to Signators by G becnnes available to the public through no fault of Signators.
Nothing in this Agreemnt shall be wnstrued as permitting Signator to unfarily obtain the right to use inforration that bewmes publicly known through an improper act or omission on their part.

Signator may not assign this Agreement.
(8) Signator Irakes no admission as to whether the information disclosed by G is, in fact, confidential information, but Signator will treat the infomation on a confidential basis.
In the event any NRC regulation, rule, or ASLB order, other adnunistrative order, or judicial ruling regtu.res the disclosure of the information without providing the equivalent protection accorded under this Agreemnt, G will have the right to inmediately withdraw the information fran Signator upon request, ard Signator will prarptly abide by

Signator will return to G all the infomation at the conclusion of his use, but in no event later than the termination of his enploymnt by Intervenor, or the conclusion of the procedures set forth in paragraph E(2) above, whichever occurs first.
