The inspection report (paragraph

5) states that the licensee eliminated this test by performing a safety review in accordance with paragraph 50.59 of 10 CFR 50.

We do not egree that the provisions of 50.59 pennit licensees to eliminate tests from their initial test program. Any planned reductions to DL approved test programs should be submitted for appropriate DL review and approval.
