Dear Mr. Berry:
This letter is in response to your telecopied letter dated August 17, 1979 regarding the implementation of Amendment No. 47 to Facility Operating License No. DPR-59 for the James A. FitzPatrick Nuclear Power Plant.
We have reviewed your request as well as the Co raission's documents related to the amendment. We have determined that the effective date of the amend-ment should have been 20 days from the publication of the NOTICE in the FEDERAL REGISTER which occurred on August 9, 1979 (44 FR 46962).
Since.the contents of the license amendment were discussed previously with members of your staff, we believe a 30 day extension in implementation is not justified. However, we believe that a 20 day period from date of publication in the FEDERAL REGISTER is appropriate. Therefore, page 2 to the license amendment should shcw an effective date of August 29, 1979.
