Dear Dr. Baer:

This concerns your letter of June 28, 1979 in response to our letter of June 1,1979 concerning your intenticns regarding the portions of your Nuclear Regulatory Commission (NRC) License No. 13-10042-01 (Docket No. 27-39) which authorizes receipt, possession, storage, and transportation of radioactive material in non-Agreement States. As you know, your license and these activities continue by virtue of your renewal application dated August 16, 1968 which was deemed timely by the Commission.

In your June 28 letter, you state that your updated renewal application submitted by letter dated February 24, 1978 for the Richland site was also meant to cover these activities.

We therefore conclude that you wish to continue to hold a license to receive, possess, store, and transport radioactive material in non-Agreement States.

However, you should be aware of the following:

a.

The information contained in your updated renewal application submitted by your February 24, 1978 letter is inadequate for us to reach conclusions regarding protection of the public health and safety in cennection with storage and transportation activities in non-Agreement States.

The updated renewal application form (Fonn AEC-313) submitted by you as part of the application only covers operations at the Richland disposal site.

The manuals submitted with the renewal application briefly discuss truck driver training and emergency plans for activities within the State of Washington.

Otherwise, there is no information in your renewal application, manuals, or any other submitted information that discusses receipt, possession, storage, and transport of radioactive material in non-Agreement States.

The material contained in the updated renewal application for the Richland site has been assigned Docket No.

27-48 and any license issued by us under Docket No.

27-48 will solely pertain to operations at the Richland site.

In order for us to review that portion of your renewal application covering receipt, possession, storage, and transport of radioactive material in non-Agreement States, you need to fill out and return the enclosed form AEC-313.

When we receive this form (and the supplimentary information discussed below),

it will be assigned a different docket number than' either 27-39 or 27-48.

Any license issued by us under this docket will solely pertain to receipt, possession, storage, and transport of radioactive material in non-Agreement States.

As provided for in 10 CFR Part 170, no new application fee will be required for your submittal of form AEC-313.

Separation of the Richland license and the license for receipt, possession, storage and transport in non-Agreement States is for the convenience of NRC.

c.

In order for us to review your renewal application for storage and transportation activities in non-Agreement States, you need to ensure that the following information is included with your submittal of the completed fonn AEC-313:

1.

Whether you propose to store packages in non-Agreement States.

If so, we need to know the specific storage locations and a description of each storage facility.

2.

The maximum quantities of byproduct, source, and special nuclear material you wish to possess at any one time and the chemical forms of these material s.

For special nuclear material, the maximum amount in a single package must also be specified.

These quantities should include material in transit and in storage.

3.

The names of the individual (s) who will be responsible for your radiation safety program, their specific duties and responsibilities, and their training and experience in radiation safety and in the operations which you plan to carry out.

4.

The specific written operating and emergency procedures which will be given to each person involved in the licensed activities.

These procedures should contain specific innructions for all operations you wish to carry out.

In these instructions, you must describe the means used by personnel to verify that waste packages meet the U.S. Department of Transportation (DOT) and NRC packaging requirements as well as license conditions at storage locations or disposal sites.

The training which will be given to personnel involved in the licensed activities. The description of the training program should include the specific +.opics covered in training, the amount of time spent on each topic, the time which will be spent in on-the-job training, and how competency of individuals to independently carry out operations is determined.

The names of the persons who will carry out training and their qualifications to conduct such training should be included.

6.

The instructions which you give your customers concerning the types of packages you will accept, and how packages should be prepared.

7.

Your plans for using your own vehicles or arranging for common carrier shipments to storage locations or to disposal sites.

d.

To assure that all operations in non-Agreement States are carried out in a uniform and safe manner and to avoid unnecessary confusion for your employees, your submittal of a single set of operational and management audit and control procedures must cover all activities in non-Agreement States.

Regardless of how many NECO operations are covered by individual Agreement State licenses, future operations in non-Agreement States must be uniformly conducted and solely in accord with a license issued by us based on our review of your submittal.

Please submit the completed form and supplementary information to the e.

Material Licensing Branch, Division of Fuel Cycle and Material Safety.

The Material Licensing Branch will be responsible for review of your submittal and for issuance of any license based on that reveiw.
