Dear Sirs:
On August 7,1979, the Co-4sion extended the ti=e for consideration of petitions to reviev the decision of the Ato=ic Safety and Licensing Appeal 3 card in the subject case.
That time period has cov elapsed without the Co-4ssion : anting the petition in whole or in part.
Accordingly, the petition is dee=ed denied as provided in 10 CIR
- 2. 786 (b) (5).
Co=nissioner Iennedy would have accepted review of the third and final cajor issue before the Appeal Board, i.e., "whether the Licensing 3 card erred in refusing to condition the denial of the motion to quash the subpoena on the assu=ption by DUR of all expenses incurred by Edison in complying with the subpoena."
