NRC STAFF RESPONSE TO THE PETITION TO INTERVENE FILED BY ELINORE P. CUMINGS By undated petition docketed July 26, 1979, Elinore P. Cumings requested admission to this proceeding as a full party. Ms. Cumings states that she lives within 50 miles of the proposed plant site; that she is concerned about possible effects on her family by the operation of the plant; and that she is specifically interested in aspects of the proceeding regarding alternate energy sources; nuclear waste storage; the cost-benefit balance; quality assurance; and the growing population near the site.
Although the Staff believes that Ms. Cumings has complied with the requirements of 10 CFR 62.714(a)(1) and (2) by showing a personal interest and possible injury in fact as well as an interest in a specific aspect of the proceeding, it is not. clear whether or not the petition is timely filed, since no date appears on the pleading and the docketing date is well after the July 18, 1979, deadline for filing petitions.

Therefore, the Staff asks that Ms. Cumings submit a statement of the date on hi-5 she mailed her petition to the Commission.
In the event that Ms. Cumings did not timely file her petition, she must file another petition which addresses the factors listed in 10 CFR 52.714(a)(1)(1) through (v) which will allow the Board and parties to determine whetner or not admission of a nontimely filing should be granted.
To assist Ms. Cumings in compliance with the Comission's Rules of Practice, either in regard to nontimely petitions, if necessary, or to enable her to complete her present petition by submitting at least one litigable contention as required by 10 CFR 52.714(b), the Staff is forwarding to her a copy of 10 CFR Part 2.
The Staff believes no decision should be made concerning admission of Ms. Cumings as a party to this proceeding until she has informed the bard and parties as to the date her petition was deposited in the mail, or, alternatively, until she files another petition addressing the factors pertinent to nontimely filings.
