Thank you for your April 19, 1979 letter on low-level waste (LLW) disposal capa city.
4ne Comissior, apareciates your concerns regarding assurance of adequate regier. ally distributed disposal capacity for LLW; in fact, it does appear tha: the Barnwell site is receiving a major fraction of the coamercially generated LLW.
In this regard, the Co=ission notes tha: you supcort the curren-license volume liti atic. for disposal of LLW a:

Action by DDE ir. preparing a plan, wnen cottoled writh implementation, should meet any imediate short range needs for LL'W disposal capaci y which the cormercial sector is unable to provide.
To address the longer range concerns regarding adequate capacity, 'we partici-pated.in and continue to support the recomendation of the Interagency Review Group on Nuclear Waste Management that DOE take the lead in prepara-tion of a national waste nanagement program plan.
We understand DOE will be direc sc :c work closely with o:.er Feoeral agencies, s:2.tes, industry, and the p.:blic ir th= deveicpmen of such a plan which may i.ciude the-sitin;; cf was e car.agerer.: f acilities en E egional basis.

With respect to N?.C's LLW regulatory program, we are moving ahead to~ assure that foc.al regulations, supporting regulatory guides, and licensing procedures are available it: a timely manner to meet siting needs and to address disposal actions such as disposal of waste generated by the incident at Thnee Mile Island. We plan to propose focal regulations and technical criteria for shallow land disposal next year.
A part of our program also includes the examination of alternative disposal methods for LLW.
We plan to propose mgulations for one alternative disposal method (e.g., intermediate depth _
burial er mined cavity disposal) by 1982.
We agree that managemer.t of LLW is a national proble.T recuiring a T ationa1 solution.
We bel' eve that resolution of :ne problem is underway and we pian to work closely vi th South Carolina and other states in this naticTial effort.

k'e nave received a congressional request for a report concerning the Governor of South Cerolinc's i= position of limitations on the use of the Chen Kuclear faciliry at Barnwell, South Carolina, a licensed, privately-owned low-level nu: lear vaste burial facility.
In a letter te you dared April 19, 1979, the Governor of South Carolina indicatec that the facility could not accom::odate excess waste from the Three Mile Island, Pennsylvania nuclear power facil-ity, nor f ro any unscheduled reactor shut-downs.
He concluded that the volume limitations for the Chem Nuclear site should be lowered.
In this regard, we would like your comments as to whether there is any legal basis for the position that:
1.
The Chem Nuclear facility at Barnwell, South Caro h n, or any waste burial facility, was licensed to handle vastes from either (1) a particular region of the country, or (ii) from a specific geographic area.
2.
The Governor or any state official has the authority to establisb monthly or annual limitations on the volume of waste received by such a facility, and if so, what criteria is used to establish such a limitation?

Program, how would such actions comply with Section 274d(2) of the Atomic Energy Act of 1954, as amended, which requires that a state program be co=patible with the Commission's program for the regulation of such caterials?
