This is in response to your request of May 11, 1979 for the Nuclear Regulatory Commission's comments on the legal bases fpr Governor Riley's stat.ement and actions regarding the disposal o'f low-level waste at Chem-Nuclear's facility at Barnwell, South Carolina.

As you may know, Congressman Dingell asked for our views on the same matters.

These matters presented substantial issues which requirec sor,'e time to analyze. The Commission has now completed its consideration of these issues and has recently transmitted its reply to Congressman Dingell.

A copy of that reply is enclosed.
