Dear Mr. Allen:
This is to confirm the cocments made to you arJ Mr. Borchert by Mr. Bolling following the ccmpletion of the recent regulatory review of the Kansas program.
Based on the results of the review, the staff believes that the State's program for control of agreement materials is adequate to protect the public health and safety and is compatible with the Nuclear Regulatory Commission's program. We believe that the quality of work by the Bureau of Radiation Control staff is high but that the number of overdue inspections deserves immediate atteltion. We noticed a definite improvement in the quality of both the licenses and inspection reports which we believe reflect your efforts to impiment our comments and recocmendations made following last year's review.
Further improvements can be made and specific cocments and recommendations are enclosed.
I would appreciate your review of our recommendations and receiving your cocments regarding them.

COMMENTS AND RECOMMENDATIONS I.
LICENSING 7-A.
Comment During a review of selected license files, it was noted that one broad academic license had many outdated references and this license lacked a ban on plutonium air shipments.
Recommenda tion We believe hat renewal in entirety at five year intervais is necessary to update license conditions and license support informstion. Such renewals should stand on their own and not refer to old information.
When a license authorizes possession and use of plutonium, it should contain an appropriate condition concerning restrictions on air shipment of plutoniam.
B.
Comment A review of this same broad academic license file showed that while one authorized user worked with up to ^.ve Curies of Tritium (H-3),
in unsealed form, the institution was not clearly required by license condition to provide bioassays for the user.
Rec..mme r.da ti o n We recommend that licensees using large quantities of uncontained radioactive materials establish a bioassay program to evaluate their users, including clear criteria for when bioassays shall be made.
Guidance for specific isotopes can be founo in Regulatory Guides 8.20 and 10.5 (Attached).
II. COMPLIANCE A.
Comment A review of the program's overdue inspection list reve:1ed 82 overdue inspections as of August 2,1979. Most of these inspections were in pr'iorities I and II and eighteen were overdue by up 'o two years.
Recommenda tion We recommend that every effort be made to reducing the overdue inspection backlog. Special attention should be focused on the priority I licensees since they pose the most potential hazard.

Comment A review of selected complian~ce files noted that independent measurements are not always made during inspections.

2-Recommenda tion We recommend that measurements be made to verify the licensee's measurements and compliance with regulatory requirements. The results should be documented as part of the inspection report.
