Dear Mr. Dattilo:

This letter is written in response to the referral by the Appeal Board dated March 19,1979, to the Director of Nuclear Reactor Regulation, of Save the Valley /Save Marble Hill's request to reopen the Marble Hill safety hearing because of the banning of an herbicide and the issuance of the Lewis Report.

This letter also responds to your later requests of April 4,1979, and April 19,1979, to reopen the safety hearing or issue an order to show cause to suspend the Marble Hill construction permit, based on the Three Mile Island accident. For the reasons set forth in the enclosed " Director's Decision Under 10 CFR 2.206," your requests are hereby denied.

A copy of this deterr.iination will be placed in the Cormission's Public Document Room at 1717 H Street, N. W., Washington, D. C. 20555 and at the Madison-Jefferson County Public Library, 420 West Main Street, Madison, Indiana 47250. A copy will also be filed with the Secretary of the Commission for its review in accordance with 10 CFR 2.206(c) of the Commission's regula-tions.

The allegations raised in your June 12, 1979, letter concerning the adequacy of concrete at Marble Hill are under investigation by the Office of Inspection and Enforcement.

Enclosed for your information is a copy of the notice that is being filed with the Office of the Federal Register for publication.
