Dear Mr. Collins:

The Kentucky Radiation,antrol Branch has performed a prelif arv review of the NRC staff paper entitled "Beyo'nd Defense in* Depth" (Solomon Keport).

In General, we are in full acreement with the orinciales developed in this document.

In particular, we list the rollowing items:

1) We fully agree that planning for nuclear power plants should involve reliable affsite emergency systems in aidition to protection provided by defense-in-depth within the facility.
2) We agree with the basic idea of an Emergency Planning :ene

. involving the ability to quickly and safely implement protective action in an area near the nuclear facility. However, based upon the experience at Three Stile Island, we question whether the ten (10) mile radius would be adequate for the EP2.

3) We agree with the concept of assessing sufficient funds from the utility proposing a nuclear pcwer plant to provide planning, equip-ment.and salaries to develcp and maintain the safety systems of the EP: and the environmental monitoring region beycnd the EP. We believe that contract meney shculd be provided directly to county and state prograns. This monev shculd be collected from the utility by the federal government in proportion to the actual need of the affected locality. No state er county matching funds shculd be required for these contracts.

We appreciated the cpportunity to review this document and find it a very refreshing assessment of the need and responsibilities for emergency planning for comercial nuclear reactors. We hope that this report alcng with the findings at Three Stile Island will lead to appropriate legislatien ard regu-lations to be adopted to allcw full implementarien of nuclear reacter planning activities as cutlined in the Solmen Report.
